Investigatory interviews in disguise, know your rights!
CAPT urges all BU 18 employees, no matter the circumstance or situation, to obtain union representation when a police officer or supervisor seeks information from you about an event. Even if a police officer or supervisor approaches you in a friendly manner and pulls you aside to ask seemingly harmless questions about a certain event, do not respond or provide any information. Don’t be deceived. A friendly conversation may be an investigatory interview in disguise. As we all know, investigatory interviews can lead to disciplinary action and even criminal prosecution. You must work to protect yourself and your fellow coworkers by seeking union representation before answering any questions.
In addition to guaranteeing union representation, our contract also outlines the administration of disciplinary representation for investigatory interviews. Article 2, Section 1.3 (a), specifies that an employee is to be given 24-hour advance notice, in writing or otherwise, of the subject of the interview and whether he or she may be subject to criminal or disciplinary action. Management is also required to inform the employee if, through the course of the investigation, he or she becomes the focus of the investigation. The contract also specifies time-frame constraints on investigations and other related administrative matters.
